Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Flexx AI ("we," "us," or "our") governing your use of the Flexx AI mobile application ("App") and all related services ("Services").

By creating an account, downloading, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

• You must be at least 13 years old to use the App.
• If you are between 13 and 17 years old, you must have parental or guardian consent to use the App.
• By using the App, you represent that you meet these age requirements.
• You must provide accurate and complete information when creating your account.

3. Account Registration and Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• You may not create multiple accounts, share your account, or transfer your account to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Services

Flexx AI provides the following features:

• AI Fitness Coaching (premium) — fitness guidance and conversation via Coach Flexx
• Nutrition Tracking — calorie and macronutrient logging and barcode scanning (free); meal photo and label analysis (premium)
• Workout Tracking (free) — exercise logging, generated workout programs, and progress tracking
• Health Integration (free) — optional sync with Apple Health and Google Health Connect
• Progress Tracking — weight, body measurements, and photo-based progress tracking

5. AI Disclaimer — Not Medical Advice

• The App uses artificial intelligence (including OpenAI's GPT models) to generate personalized suggestions. AI can make mistakes, produce inaccurate information, or provide recommendations that may not be suitable for your specific health conditions.
• Always consult a qualified healthcare professional before starting any new diet, exercise program, or making significant changes to your health routine, especially if you have pre-existing medical conditions, injuries, or are pregnant.
• Calorie estimates from meal photo analysis are approximations and should not be relied upon for medical dietary requirements.
• We are not responsible for any health consequences resulting from following AI-generated suggestions.
• If you experience pain, dizziness, shortness of breath, or any concerning symptoms during exercise, stop immediately and seek medical attention.

6. Subscriptions and Payments

6.1 Subscription Plans

Flexx AI offers the following subscription plans:

• Monthly Plan: $24.99 per month
• Annual Plan: $199.99 per year

Both plans include a 3-day free trial for new subscribers. Prices may vary by region and are displayed in your local currency in the App Store or Google Play Store.

6.2 Free Features

Without a subscription, you can access: manual food logging, barcode scanning, food and exercise search, the complete workout engine (personalised plan generation, monthly plan renewal, progressive overload and automatic level-up), optional Apple Health / Google Health Connect sync, progress tracking, and settings and profile features. Features powered by artificial intelligence — Coach Flexx, meal photo and label scanning, AI meal plans, post-workout analysis and weekly reports — require a paid subscription.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period. Your App Store or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.

6.4 Free Trial

The 3-day free trial provides full access to all premium features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your account will be charged.

6.5 Cancellation

You can cancel your subscription at any time through:

• iOS: Settings > [Your Name] > Subscriptions > Flexx AI
• Android: Google Play Store > Subscriptions > Flexx AI

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. No partial refunds are provided for unused time.

6.6 Refunds

All purchases are processed through Apple's App Store or Google Play Store. Refund requests must be directed to the respective store:

• Google: Google Play refund support

We do not process refunds directly.

6.7 Price Changes

We reserve the right to change subscription pricing. Any price changes will apply to the next billing period after notice is provided. Existing subscribers will be notified in advance through the App Store or Google Play Store.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use the AI coach to generate content that is harmful, abusive, threatening, or harassing
• Upload photos that are obscene, illegal, or that you do not have the right to share
• Attempt to access another user's account or data
• Use automated scripts, bots, or scrapers to interact with the App or its APIs
• Circumvent subscription requirements or attempt to access premium features without payment
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Misrepresent your identity or provide false information
• Use the App to promote competing products or services

8. Intellectual Property

8.1 Our Intellectual Property

The App, including its design, code, features, AI models integration, branding, logos, and all related content, is the intellectual property of Flexx AI and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

8.2 Your Content

You retain ownership of all content you submit to the App, including photos, food logs, workout data, and other personal data. By submitting content, you grant us a limited, non-exclusive license to process, store, and display that content solely for the purpose of providing the Services to you.

This license terminates when you delete your account.

8.3 AI-Generated Content

Content generated by our AI features (meal suggestions, coaching advice, analyses and reports) is provided for your personal use. You may not commercially redistribute AI-generated content from the App.

9. Account Termination

9.1 Termination by You

You may delete your account at any time from the App's Settings. Account deletion permanently removes all your data as described in our Privacy Policy.

9.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in abusive or harmful behavior
• Attempt to exploit or compromise the App's systems
• Use the App in a manner that could harm other users or the service

We will make reasonable efforts to notify you before termination unless immediate action is required to protect the service or other users. If your account is terminated for violations, you may not be entitled to a refund of any subscription fees.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

• The App and Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
• We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
• We do not warrant the accuracy, completeness, or reliability of any AI-generated content, nutritional data, calorie estimates, or fitness recommendations.
• We are not liable for any injuries, health issues, or adverse effects resulting from following suggestions provided by the App or its AI features.
• In no event shall our total liability exceed the amount you have paid us in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits.

11. Indemnification

You agree to indemnify, defend, and hold harmless Flexx AI, its developer, and any affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the App

12. Service Availability and Modifications

• We strive to keep the App available at all times but do not guarantee uninterrupted service.
• We may modify, update, or discontinue features at any time without prior notice.
• We may perform maintenance that temporarily makes the App unavailable.
• We are not liable for any loss or inconvenience caused by service interruptions.

13. Third-Party Services

The App integrates with third-party services (Apple Health, Google Health Connect, OpenAI, Tavily, Google Firebase, RevenueCat, Sentry, FatSecret, USDA FoodData Central, Open Food Facts). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

14. Dispute Resolution

We encourage you to contact us first at flexxaiapp@gmail.com to resolve any disputes informally. Most concerns can be resolved quickly through direct communication.

If a dispute cannot be resolved informally within 30 days, both parties agree to attempt mediation before pursuing formal legal action.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. For users in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flexx AI regarding your use of the App and supersede all prior agreements and understandings.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top. For material changes, we will notify you through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
